hillyard outside the courthouse in lower manhattan. also here with us, charles coleman. vaughn, let's start with you outside there, the jury has heard a lot from the defense and the prosecution, what are the final points they're all trying to drive home right now in. >> reporter: right, for nearly three hours this morning, guys the defense team for donald trump, his lead attorney pressing the case to this jury they have reasonable doubts that donald trump is guilty of these 34 counts of falsifying business records. on one hand they make the case that there was no intent on the part of donald trump to defraud when he reimbursed michael cohen for that money, not only reimburse they make the case to the jury that there's no evidence that shows that donald trump was doing anything other than retaining michael cohen and they were calling into question the credibility of michael cohen as a whole, more than 45

different times they either called michael cohen a liar or implied that he lied to this jury during his several days' of testimony. the marquee witness to bring all 21 witnesses' accounts together as well as that documented evidence there, they're calling into question, again, for the jury that there's reasonable doubt in that should keep them from finding donald trump guilty and they should acquit him of the charges. for the prosecution here, ongoing here this afternoon they're making the case that michael cohen was the ultimate fixer for donald trump and cohen served his time out of loyalty for donald trump did what he did and is now coming clean and he only corroborates the body of evidence brought forward. >> the prosecution is up now, what do they really need this jury to believe? if they take a long time saying

last week, today the judge reopened his sentencing hearing after realizing she didn't get a chance to speak for himself during that initial hearing. steve patterson has been following this case and joins us now from los angeles, steve, depape was given his chance to speak today, what did we hear from him in court and did today change anything? >> reporter: i mean, no. look, i mean, this was obviously a clerical error, a human error by the judge a few weeks ago, today she wanted to offer david depape a chance to speak and he did read a written statement. we had reporter there during the hearing. i'll paraphrase, this is just a paraphrase, essentially, i'm sorry for what i did to paul pelosi, i should have left when nancy pelosi wasn't there. he's never done anything violent before. we heard he did break down and

about a mile away in oakland on macarthur and 98th. that's where police were responding to reports of shots fired. an officer on the scene told our photographer that someone was shot while sitting in a car, you should be able to see in the video the dozens of shell casings on the ground at that location. after the shooting, the victim drove himself to the location where i'm at again, about a mile away, their vehicle crashing into that white van which crashed into this building, and obviously that green pickup truck as well, the black car that the victim was driving wrecked up on the sidewalk, where again, he was declared dead from his gunshot wounds because it was really loud. and so the guy was sitting in the car. i couldn't vaguely i could see him, but i couldn't get a good look at him. but he wasn't moving at all. so apparently he must have been dead, because that car had to be going over 100 and some miles per hour. you know, it was going crazy again. no one was in the white van. the person was parked

in the green pickup truck. he's okay. but of course, the man who was shot and ended up crashing here has passed away. we have reached out to oakland police. so far there are no reports of any arrests here in san leandro. bob redell nbc bay area news. a judge in san francisco ruled that paul pelosi's attacker, david depape, sentencing, will stay at 30 years in prison. that's after fixing a court error after depapes guilty verdict. he wasn't given the chance to speak in court at a sentencing hearing, which was error. so today the judge gave him that chance. deepak spoke for about five minutes, apologized for his actions. however the judge said that to perhaps 30 year sentence will not change and tomorrow opening statements for the state trial will begin. his attorneys are arguing the state charges should be dismissed. they're citing double jeopardy following his federal conviction. right now, san jose police are investigating a homicide that led to an hours long standoff. it all happened along north 20th and julian near coyote creek. police say they received reports

of a shooting at a home around six last night. and when they got there, they had to engage with a man barricaded inside that home. after about 2.5 hours, he surrendered. but a woman was found dead inside the home. the victim and the suspects identities have not been released. san jose police are holding a news conference at 2 p.m. with an update on this investigation. meanwhile, in concord, we want to tell you what's going on in there. there were very busy with another barricaded suspect at the three hour standoff ended around 9 p.m. in the front yard of rosbrook court home. the incident also triggered a shelter in place. still not clear exactly what led to this. our crews were there when police ordered the suspect to the ground and arrested the person. fortunately, no one was hurt. we're going to switch gears now and talk about our weather. another beautiful day. here's meteorologist kari hall with our forecast. we're looking forward to a comfortably warm day with our high temperatures in the mid to upper 70s all across the south bay, and we're looking at a lot of sunshine, but it will

dangerous and it has the word dangerous in it for a reason, because of the potential for harms, but also the potential benefits, we use these drugs and we use them routinely depending on type of drug, insomnia as well as things like anxiety or complex seizure disorders. a number of uses for these drugs. and pain control, i know that can get cocomplicated, too. it's not one size fits all. >> can you walk us through what type of drugs fall into this specific category? >> well, let's start with schedule 1, highest potential for abuse, not any sort of medical use and that's something like heroin or lsd. schedule ii, iii, iv and v, the least possible for abuse but potential harms we need patients

to watch out for. dextromethorphan is commonly used in cough medicine. drugs like ambien for insomnia -- >> i've done a lot of stories about controlled substances and the danger of addiction, but painkillers being needed by a lot of people out there, so what are some signs that somebody might be developing a dependency? >> a great question. couple of signs are fizz logical signs, when they don't have access to a drug they can feel different when they think about not getting the drug, a warning sign you could have a dependency to that drug and then there are other signs of dependency such as taking more than what's prescribed. most of the time we give
